Terms of Service

These Terms of Service (“Terms”) govern access to and use of https://cedarloria.com and the related online store, content, features, products, and services (collectively, the “Services”).

The terms “cedarloria,” “we,” “us,” and “our” refer to cedarloria.

Our ecommerce store is hosted by Shopify, which provides the ecommerce platform used to make the Services available.

By accessing or using the Services or placing an order, you agree to these Terms and the policies incorporated by reference.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Account Information

You must have the legal capacity required under applicable law to enter into a purchase contract, or otherwise have any permission or representation required by law.

You agree to provide current, accurate, and complete information when:

  • Creating an account;

  • Placing an order;

  • Providing billing or shipping details; or

  • Otherwise interacting with the Services.

You are responsible for protecting your account credentials and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed or used without authorisation.

2. Store Information and Incorporated Policies

The following cedarloria policies form part of these Terms where applicable:

  • Privacy Policy;

  • Return and Refund Policy;

  • Shipping Policy; and

  • Contact Information.

These policies are available through https://cedarloria.com.

If there is a conflict between these Terms and a policy dealing specifically with a particular subject, the more specific policy will generally apply to that subject, subject to mandatory applicable law.

3. Products and Product Information

We make reasonable efforts to describe and display products accurately.

However, actual product colours may vary because of:

  • Lighting;

  • Photography;

  • Screen settings;

  • Device or display differences; and

  • Normal manufacturing variations.

Measurements, dimensions, and size guidance are approximate unless expressly stated otherwise.

Customers should review the applicable:

  • Product description;

  • Materials;

  • Care instructions;

  • Dimensions;

  • Size information;

  • Price; and

  • Availability

before placing an order.

We do not represent that a product is manufactured, designed, or sourced in Spain, the European Union, or any other particular country unless the applicable product page expressly and accurately states that information.

Any claim concerning a product's:

  • Origin;

  • Environmental characteristics;

  • Certification;

  • Performance;

  • Health characteristics;

  • Safety characteristics; or

  • Other specific attributes

applies only where supported and expressly stated on the applicable product page.

Nothing in this section limits mandatory consumer rights concerning product safety, conformity, quality, durability, fitness for purpose, or accuracy of description.

4. Prices, Currency, Taxes, and Promotions

Prices are displayed in the currency shown on the website or during checkout.

The currency and total amount displayed during checkout will apply to the order, subject to correction of obvious errors where permitted by applicable law.

Applicable taxes, delivery charges, and other mandatory charges collected by us will be displayed before the order is submitted where required.

cedarloria provides free standard shipping where stated on the website or during checkout.

Any customs duties, import taxes, brokerage charges, or destination-specific charges not collected at checkout are handled in accordance with our Shipping Policy.

Prices and promotions may change prospectively.

Any:

  • Discount;

  • Reference or comparison price;

  • Stock statement;

  • Countdown;

  • Promotional statement; or

  • Limited-availability statement

will apply only where genuine and accurately described.

If a material pricing or listing error occurs, we may contact you before accepting or fulfilling the affected order.

Where permitted by applicable law, we may offer you the choice to:

  • Proceed with the corrected information; or

  • Cancel the affected item or order and receive the applicable refund.

Promotion-specific conditions may apply.

Where promotion-specific conditions conflict with these Terms, those conditions will apply to the relevant promotion, subject to mandatory consumer law.

5. Orders and Contract Formation

Submitting an order constitutes an offer to purchase the products included in that order.

An automated order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been finally accepted.

To the extent permitted by applicable law, acceptance may occur when we:

  • Confirm fulfilment;

  • Dispatch the order; or

  • Otherwise expressly confirm acceptance.

Before submitting an order, customers should have an opportunity to review relevant order information and correct identifiable errors.

We may refuse, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Suspected fraud;

  • Unauthorised payment;

  • Payment failure;

  • Incorrect or incomplete customer information;

  • Delivery restrictions;

  • Material pricing or listing errors; or

  • Material violation of these Terms.

If cedarloria cancels an order after payment has been captured, we will refund the applicable cancelled amount to the original payment method.

We may reasonably limit quantities purchased per customer, household, account, payment method, billing address, shipping address, or order where reasonably necessary to prevent fraud, abuse, or unauthorised resale.

Nothing in this section limits mandatory consumer rights arising after a contract has been concluded.

6. Payment

Payment methods available during checkout may be provided by Shopify or authorised third-party payment providers.

By submitting an order, you represent that you are authorised to use the selected payment method and authorise the applicable charges displayed before order submission.

Payment information is processed by Shopify and authorised payment providers according to their respective terms, security practices, and privacy notices.

cedarloria does not ordinarily receive or store complete payment-card numbers.

We may conduct lawful:

  • Fraud-prevention checks;

  • Payment-verification checks; or

  • Order-verification checks

before fulfilling an order.

7. Shipping and Delivery

Orders are normally processed within 1–3 business days after payment authorisation and order confirmation.

After dispatch, standard delivery is normally estimated at 7–15 business days.

The estimated total delivery time is therefore generally approximately 8–18 business days.

Free standard shipping applies where stated on https://cedarloria.com or during checkout.

Delivery timeframes are estimates unless expressly stated as guaranteed.

Complete information concerning:

  • Shipping destinations;

  • Processing times;

  • Tracking;

  • Delivery delays;

  • Customs charges;

  • Lost shipments;

  • Damaged shipments;

  • Incorrect addresses; and

  • Other delivery matters

is contained in our Shipping Policy.

Where applicable EU or Spanish consumer law applies, goods will be delivered within the period agreed with the consumer.

Where no different delivery period has been agreed, goods will generally be delivered without undue delay and no later than 30 days after conclusion of the contract, as required by applicable law.

8. Risk During Delivery

Where cedarloria arranges delivery to a consumer, the goods generally remain at cedarloria's risk until the consumer, or a third party identified by the consumer other than the carrier, obtains physical possession of the goods, subject to applicable law.

Carrier tracking information may be considered when investigating a delivery issue, but it does not override mandatory consumer rights.

Different rules may apply where the consumer independently commissions a carrier that was not offered by cedarloria, to the extent permitted by applicable law.

9. Returns, Refunds, and Cancellations

cedarloria 30-Day Voluntary Return Policy

Eligible returns may generally be requested within 30 calendar days after delivery, subject to our Return and Refund Policy and applicable law.

Our Return and Refund Policy governs matters including:

  • Return eligibility;

  • Return procedures;

  • Return instructions;

  • Return shipping responsibility;

  • Non-returnable goods;

  • Damaged or defective goods;

  • Incorrect or missing products;

  • Return inspection; and

  • Refund processing.

cedarloria covers approved return shipping costs for verified:

  • Damaged products;

  • Defective products;

  • Materially misdescribed products; or

  • Incorrect products.

For preference-based returns under our voluntary return policy, customers are generally responsible for return shipping costs.

Examples include:

  • Change of mind;

  • Fit concerns;

  • Ordering the wrong size;

  • Ordering the wrong colour; or

  • No longer wanting the product.

Approved voluntary returns are not subject to a separate restocking fee.

10. EU and Spanish Statutory Right of Withdrawal

Where applicable Spanish or European Union distance-contract rules apply, consumers purchasing eligible goods online generally have a statutory right to withdraw from the contract without giving a reason.

For most eligible goods, consumers generally have 14 calendar days from the day they receive the goods to communicate their decision to withdraw.

The consumer may exercise the right by making a clear statement communicating the decision to withdraw.

After validly communicating the withdrawal, the consumer generally has a further 14 calendar days to return the goods, subject to applicable law.

This statutory right exists independently of cedarloria's voluntary 30-day return policy.

11. Exceptions to the Statutory Right of Withdrawal

Certain goods and contracts may be excluded from the statutory change-of-mind withdrawal right where permitted by applicable law.

Examples may include:

  • Goods made to the consumer's specifications;

  • Clearly personalised goods;

  • Goods liable to deteriorate or expire rapidly;

  • Sealed goods unsuitable for return for health-protection or hygiene reasons after unsealing;

  • Sealed audio, video, or computer software after unsealing; and

  • Other goods or services falling within a statutory exception.

A statutory withdrawal exception does not remove rights relating to goods that are faulty, damaged, misdescribed, unsafe, or otherwise non-conforming.

12. Refunds Following Statutory Withdrawal

Where an applicable statutory withdrawal right has been validly exercised, cedarloria will reimburse the amounts required by applicable law without undue delay.

Reimbursement will generally be made no later than 14 calendar days after we are informed of the consumer's decision to withdraw.

For contracts involving returned goods, we may generally withhold reimbursement until:

  • We receive the goods back; or

  • The consumer provides appropriate evidence that the goods have been returned,

whichever occurs first, where permitted by applicable law.

Refunds will generally be made using the same payment method used for the original transaction unless another method is expressly agreed.

13. Return Shipping and Original Delivery Costs

Where a statutory withdrawal is based solely on a change of mind, the consumer generally bears the direct cost of returning the goods where properly informed of that responsibility before entering into the contract.

cedarloria will bear appropriate return costs where required because goods are:

  • Defective;

  • Incorrect;

  • Materially misdescribed;

  • Non-conforming; or

  • Otherwise subject to a legal requirement that the seller bear the cost.

Where a consumer paid for outbound delivery and statutory withdrawal rules require reimbursement of delivery costs, cedarloria will generally reimburse the amount corresponding to the least expensive standard delivery option offered for the order.

Additional amounts paid solely because the consumer selected:

  • Express delivery;

  • Priority delivery;

  • Expedited delivery; or

  • Another more expensive delivery option

generally do not have to be reimbursed above the cost of standard delivery, unless applicable law requires otherwise.

14. Order Changes and Cancellations Before Dispatch

Please include your order number.

We will make reasonable efforts to accommodate your request, but changes or cancellations cannot be guaranteed once processing or fulfilment has begun.

If cedarloria cancels an order after payment has already been captured, the applicable amount will be refunded.

Nothing in this section limits a statutory withdrawal or cancellation right.

15. Product Conformity and Legal Guarantee

Nothing in these Terms limits mandatory product-conformity rights under applicable Spanish or EU consumer law.

Goods supplied by cedarloria should comply with applicable contractual and legal conformity requirements.

Depending on the product and circumstances, relevant characteristics may include:

  • Description;

  • Quality;

  • Functionality;

  • Compatibility;

  • Durability;

  • Safety;

  • Fitness for the normal purpose of goods of the same type; and

  • Any specific purpose accepted by the seller where applicable.

For qualifying new consumer goods sold in Spain, the statutory conformity period is generally three years from delivery.

Where goods lack conformity, consumers may be entitled to statutory remedies.

Depending on the circumstances, these may include:

  • Repair;

  • Replacement;

  • Price reduction;

  • Termination of the contract and refund; or

  • Another remedy required by applicable law.

Any commercial guarantee or warranty is additional to, and does not replace or reduce, mandatory statutory rights.

The expiration of cedarloria's voluntary 30-day return period does not automatically end statutory rights concerning defective or non-conforming goods.

16. Customer Communications, Reviews, and User Content

If you submit a:

  • Review;

  • Photograph;

  • Video;

  • Comment;

  • Suggestion;

  • Feedback; or

  • Other content,

you represent that:

  • You own the content or have permission to submit it;

  • The content is lawful;

  • Where represented as a review or personal experience, it reflects your genuine experience; and

  • It does not infringe another person's intellectual-property, privacy, or other rights.

You retain any ownership rights you have in content you submit.

To the extent permitted by applicable law, you grant cedarloria a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use submitted content for purposes reasonably connected with operating, improving, and promoting the Services.

We do not require positive reviews and do not prohibit honest negative feedback.

We may remove or decline to publish content that is:

  • Unlawful;

  • Fraudulent;

  • Abusive;

  • Deceptive;

  • Irrelevant;

  • Infringing; or

  • Otherwise prohibited by applicable law or applicable platform rules.

17. Acceptable Use

You must not use the Services to:

  • Violate applicable law or another person's rights;

  • Submit false, misleading, fraudulent, malicious, or unlawful information;

  • Interfere with website security, checkout functionality, networks, or another customer's use;

  • Introduce malware, viruses, harmful code, or malicious technology;

  • Attempt unauthorised access to systems, accounts, networks, or data;

  • Use unauthorised automated scraping, crawling, or data-extraction tools;

  • Impersonate another person or misrepresent your identity or affiliation;

  • Conduct payment fraud;

  • Knowingly engage in fraudulent or abusive chargeback activity;

  • Engage in unauthorised resale or fraudulent purchasing activity; or

  • Copy, reproduce, or commercially exploit website content beyond permissions granted by law or these Terms.

We may restrict or terminate access for material violations of these Terms, subject to applicable law.

Termination does not affect rights or obligations that arose before termination.

18. Intellectual Property

The cedarloria name, branding, logos, website design, text, graphics, photographs, videos, product presentation, and other content made available through the Services are owned by cedarloria, its licensors, or other applicable rights holders.

Such content may be protected by applicable:

  • Copyright;

  • Trademark;

  • Design;

  • Database; and

  • Other intellectual-property laws.

You may access and use the Services for lawful, personal, and non-commercial shopping purposes.

Except where expressly permitted by applicable law or these Terms, no ownership interest or intellectual-property licence is granted to you.

Third-party product names, trademarks, logos, and other intellectual property remain the property of their respective owners.

Their appearance through the Services does not necessarily imply sponsorship, affiliation, or endorsement unless expressly stated.

19. Third-Party Services and Links

The Services may use or link to independent third-party services, including:

  • Shopify;

  • Payment providers;

  • Delivery carriers;

  • Analytics providers;

  • Advertising platforms;

  • Social-media services; and

  • Other websites or online services.

Third-party services operate independently and may be governed by their own terms and privacy notices.

To the extent permitted by applicable law, cedarloria is not responsible for independent third-party content, systems, or practices outside our reasonable control.

Shopify provides the ecommerce platform used by cedarloria but is not the seller of products purchased directly from cedarloria.

Questions concerning cedarloria orders should therefore be directed to cedarloria.

20. Privacy

Our collection, use, processing, retention, and disclosure of personal data are governed by our Privacy Policy available through https://cedarloria.com.

Our Privacy Policy explains matters including:

  • Personal data we collect;

  • Purposes and lawful bases for processing;

  • Cookies and similar technologies;

  • Marketing preferences;

  • Advertising practices;

  • International data transfers;

  • Data retention;

  • GDPR rights; and

  • How to submit a privacy request.

21. Website Availability

We make reasonable efforts to keep the Services available and functioning properly.

However, we do not guarantee that website access will always be uninterrupted, secure, or error-free.

The Services may occasionally be unavailable because of:

  • Maintenance;

  • Technical problems;

  • Security incidents;

  • Third-party service disruption; or

  • Circumstances outside our reasonable control.

Nothing in this section excludes or limits statutory rights or responsibilities that cannot lawfully be excluded.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these Terms do not exclude or restrict mandatory liability relating to matters such as:

  • Fraud or fraudulent conduct;

  • Death or personal injury where liability cannot legally be excluded;

  • Mandatory product liability;

  • Mandatory consumer-protection obligations;

  • Defective or unsafe products; or

  • Other liability that applicable law requires us to bear.

Subject to mandatory applicable law, cedarloria will not be responsible for losses that are not reasonably foreseeable consequences of a breach where such exclusion is legally permitted.

Nothing in this section limits mandatory remedies concerning:

  • Faulty goods;

  • Non-conforming goods;

  • Unsafe goods;

  • Misdescribed goods;

  • Undelivered goods; or

  • Other legally non-compliant goods or services.

Where a limitation is prohibited or unenforceable, it will apply only to the maximum extent legally permitted.

23. Responsibility for Unlawful Misuse

To the extent permitted by applicable law, you may be responsible for reasonable losses or costs directly resulting from:

  • Your unlawful misuse of the Services;

  • Your intentional infringement of another person's rights;

  • Fraudulent activity; or

  • Malicious conduct.

Nothing in this section makes a consumer responsible for losses caused by cedarloria's own:

  • Breach;

  • Negligence;

  • Unlawful conduct; or

  • Failure to comply with mandatory legal obligations.

24. Fair and Transparent Terms

These Terms are intended to be fair, clear, and transparent.

Nothing in these Terms is intended to:

  • Create an unfair imbalance in the parties' rights and obligations;

  • Mislead consumers about their statutory rights;

  • Exclude responsibility that cannot lawfully be excluded;

  • Impose an unlawful penalty on a consumer; or

  • Prevent a consumer from relying on a mandatory legal remedy.

If a provision conflicts with a mandatory consumer-protection rule, the mandatory rule will apply.

25. Electronic Communications

By placing an order or using the Services, you agree that transactional communications may be provided electronically.

These communications may include:

  • Order confirmations;

  • Receipts;

  • Shipping updates;

  • Return communications;

  • Refund notifications;

  • Account notices;

  • Security notices; and

  • Policy-related communications.

Marketing communications will be sent only as permitted by applicable law.

Where required, promotional communications will include an appropriate unsubscribe or objection mechanism.

Opting out of marketing does not prevent us from sending necessary transactional or service-related communications.

26. Governing Law and Consumer Rights

To the extent permitted by applicable law, these Terms and contracts concluded with cedarloria are governed by the laws of Spain.

However, this choice of law does not deprive consumers of mandatory protections that would otherwise apply under applicable EU law or the mandatory law of the consumer's country of habitual residence where legally applicable.

Nothing in these Terms:

  • Excludes mandatory consumer rights;

  • Restricts an applicable statutory right of withdrawal;

  • Restricts mandatory product-conformity rights;

  • Requires a consumer to waive a legal remedy that cannot legally be waived; or

  • Requires a consumer to bring proceedings in a forum where applicable law gives the consumer a right to proceed elsewhere.

Any dispute may be submitted to a court or other authority having jurisdiction under applicable law.

Customers are encouraged to contact cedarloria before commencing formal proceedings so that we can attempt to resolve the matter.

Doing so does not waive, shorten, or restrict:

  • Any statutory deadline;

  • Any limitation period;

  • Any complaint right; or

  • Any other mandatory protection.

27. Severability, Waiver, and Entire Agreement

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be applied to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

Failure by cedarloria to enforce a provision does not constitute a waiver of that provision or any other right.

These Terms, together with the policies incorporated by reference, constitute the agreement governing use of the Services and purchases from cedarloria, except for:

  • Terms expressly agreed separately in writing; and

  • Rights or obligations imposed by applicable law.

28. Changes to These Terms

We may update these Terms from time to time for:

  • Operational;

  • Legal;

  • Regulatory;

  • Security; or

  • Business reasons.

The current version will be published on https://cedarloria.com together with an updated “Last updated” date.

Changes generally apply prospectively.

Where applicable law requires additional notice or consent for a material change, we will provide such notice or obtain consent as required.

Changes will not retroactively remove or reduce rights relating to an order already accepted where doing so would be prohibited by applicable law.
